SC AG joins Suit Against Biden Administration Over Healthcare For illegal immigrants




South Carolina Attorney General Alan Wilson announced on Thursday that he is joining a federal lawsuit against the Biden administration's efforts to extend healthcare coverage to certain illegal immigrants. Wilson, along with attorney generals from 14 other states, is challenging a new rule that could allow over 100,000 illegal immigrants, who were brought into the United States as children, to enroll in the federal Affordable Care Act (ACA) health insurance marketplace.

The lawsuit targets the Biden administration's plan, which is expected to provide these individuals, often referred to as "Dreamers," with access to tax breaks when they sign up for coverage. The rule is set to take effect on November 1, coinciding with the opening of the ACA marketplace, just days before the 2024 presidential election.

Wilson expressed sympathy for those who were brought to the U.S. as children but argued that the administration is overstepping its authority. "This is yet another example of the Biden administration trying to do something that they do not have the authority to do," Wilson stated.

The lawsuit contends that the administration's action violates provisions of the 1996 welfare reform law and the ACA, and seeks to block the rule from taking effect.
